By signing up and actively using the Clickymail program you agree to all terms and conditions set forth in this agreement. Clickymail may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its members. Members will be informed of any and all changes to this policy via an email to their primary contact email address provided upon signing up with Clickymail. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the Clickymail program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change.

Responsibility of Members:

You must be 16 years of age or older to participate in this program. Our program is open to both US and International members and is void where prohibited by local governing laws.

You agree to and must use your own name and email address in the sign-up process and may not assume a false identity. You may not sign-up multiple times with different email addresses. Your computer must not be shared with another individual that has an existing Clickymail account.

You will use your email address / password combination to access your account, it is your responsibility to keep this information confidential, you may change this information by logging into your account and following the "User Account Info." link. You may not sell, gift or transfer your account to any other person. If you no longer wish to be a member of this program your only recourse is to go to your user information and delete your account. Any account found to be sold or put up for sell, gifted, or change of ownership shall be in violation of terms of service and subject to termination. You are solely responsible for any and all use of your Clickymail account authorization by you to any third party individual who may use your account is not permissable and shall be grounds for termination..

Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by Clickymail be detected it may result in member termination and possible legal action. Any solicitation of advertisers for a confirmation email for purposes of receiving credit in your account will be grounds for immediate termination.

Clickymail will send out ads with Negative Value and will employ turning numbers and hidden link ads in order to prevent the use of Click Bots. The use of Click Software is considered a violation of these terms and will result in the member losing earnings and possible termination. The use of click software will be considered fraudulent activity.

You must maintain your e-mail account that you used when signing up with Clickymail. You agree to receive e-mail advertising from Clickymail limited to no more than (200) per day.

In the event your e-mail account on file becomes closed or blocked to messages from Clickymail, your account will be terminated. This especially applies to e-mail accounts returned for being Full. Any member sending us gibberish will result in automatic termination of account and Forfeiture of All earnings to date of termination. Auto-responses will also be deleted immediately.

CHEATING :

It is your responsibilty to read and check off appropriate Keyword Selections in the "User Account Info" Area. Selecting inappropriate keywords will result in the account being suspended or terminated.

Should any instances of cheating be found either by use of Paid2Read Email Program Optimizers or other "cheating" software, multiple accounts on a single computer, we will delete that member's account.

Once an account is deleted for cheating that member gives up their right to Privacy, meaning we may and will share your username, email address, name, and IP number with other webmasters. The deleted member also gives up any right to earnings that may have resulted from the cheating. The deleted member gives up any rights to referrals and downline earnings that resulted from the cheating.

Relationship of the Parties:

You and Clickymail are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and Clickymail. You understand that you do not have authority to make or accept any offers or make any representations on behalf ofClickymail. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using the program.

Limitation of Liability:

Clickymail will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or Clickymail program, even if Clickymail has been advised of the possibility of such damages. Furthermore, Clickymail
Payments:

Members may earn by receiving paid-emails and visiting the advertiser websites after they have entered their member ID in the area on the website provided by Clickymail. Members may earn by referring new members to the Clickymail program. Members will be paid via Clickymail will pay members when their balance reaches the minimum payout rate set by Clickymail. Payments will be made throughout the month to members who request - BUT only one payment per 30 days will be paid to members. Payments will be made within 30 days in order of Payout Request.
Accounts will be scanned for activity, simply logging in without any clicked links will not constitute activity. Accounts found to be inactive requesting payment will be terminated.
A members account may be passed over for Payout if they have clicked a "Cheat Link" or a "Do Not Click" type link within past 30 days, or have a vacation setting of any kind. Or if a manager or owner has made a negative report for other possible Terms Violations (bounced emails etc) to a members account. Their payout request will be canceled and they will not be able to receive a payout for at least 30 days after such offense.




Referral Earnings are a BONUS - Affiliates are NOT required to recruit new members, sell or buy advertising to earn from MesmerizingMails!



Advertising Terms

1) Any Member who purchases and/ or Redeems for an ad from boycotted sites, porno, warez, hate, search or other non-allowed advertisement - will forfeit the amount of redemption or payment.

2) Unsuitable Content. The following types of sites are NOT allowed to advertise on Mesmerizing Mails: Sites containing nudity, pornography, gambling, tobacco or other adult material, sites encouraging illegal activity or racism, sites providing instructions or discussions about performing illegal activities, sites that promote or utilize software or services designed to deliver unsolicited email, frame-breaker sites, search ads, sites that are considered by the staff of Clickymail. Unsubstainable Sites that the Owner, Webmaster, or Manager has not been following own site terms (including but not limited to over terms for payouts, deleting members without just cause, been know to demostrate questional ethics) or any other sites Clickymail deems to be inappropriate.

3) We reserve the right to refuse Unsuitable Advertisements.


Spam:

You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your membership with Clickymail and may result in legal prosecution. Clickymail strictly enforces anti-Spamming laws. Spamming is a federal crime. Any member caught Spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. ClickymailClickymail will file charges for recovery of any earnings received from multiple sign-ups.

CHEATING:
Members who are caught cheating will have their account terminated and will not be paid their earnings.
Instances of cheating include the following:
1) Clicking on more than 3 cheat links in a 1 month period.
2) Caught using automated software to access the site.
3) Having multiple accounts. Examples: same IP address, same Payment Account or same computer ID.
4) Clicking on too many incorrect turing numbers.
5) Being inactive for 30 days or more.
6) You must click on ads not only just logging in.
7) Having incorrect info listed in user's account
8) Have bad interests selected in their accounts such as cheater, I cheat or delete me
